Provision of information according to Act No. 211/2000 Coll. on free access to information and on amendments and supplements to certain acts (Freedom of Information Act), as amended.
According to Act No. 211/2000 Coll. on free access to information and on amendments and supplements to certain acts (Freedom of Information Act), as amended (hereinafter referred to as the "Act No. 211/2000 Coll."), the Corps of Prison and Court Guard (hereinafter referred to as the "Corps") provides information that it has at its disposal. The procedure for providing information within the conditions of the Corps is regulated by Act No. 211/2000 Coll. and the Order of the Director General of the Corps No. 40/2025 on the procedure for providing access to information and the procedure for making photocopies of documents for remand prisoners and sentenced prisoners in the Corps of Prison and Court Guard, as amended by RGR No. 50/2025.
The request is submitted
a) in person or by telephone (on working days from 7:00 a.m. to 3:00 p.m.),
b) in writing (by mail or by personal submission at the registry of the obliged person on working days from 7:00 a.m. to 3:00 p.m.),
c) by fax,
d) by e-mail,
e) by any other technically feasible means.
Correspondence addresses, headquarters addresses, fax numbers and e-mail addresses of individual service offices (obliged persons) are published on the Corps website www.zvjs.sk.
It must be clear from the request to which obliged person it is addressed, the name, surname, title or trade name of the applicant, their address or registered office, which information the request concerns, and what method of information access the applicant proposes.
If the request does not contain the prescribed requirements, the obliged person shall immediately call upon the applicant to supplement the incomplete request within a set period, which must not be shorter than 7 days. If the applicant fails to supplement the request despite the call from the obliged person and the information cannot be provided due to this defect, the obliged person shall set the request aside.
The obliged person shall process the request for information without unnecessary delay, no later than 12 working days from the date of submission of the request or from the date of removing the defects of the request, and within 15 working days if the information is provided to a blind person in an accessible form according to § 16 par. 2 letter a) of Act No. 211/2000 Coll.
For serious reasons, the obliged person may extend this period, but by no more than 8 working days, and by 15 working days if the information is provided to a blind person in an accessible form according to § 16 par. 2 letter a) of Act No. 211/2000 Coll.
The obliged person shall notify the applicant of the extension of the period without delay, no later than before the expiration of the period. The notification shall state the reasons that led to the extension of the period.
If the obliged person to whom the request is directed does not have the requested information available and if they are aware of where the requested information can be obtained, they shall forward the request within 5 days from the date of delivery of the request to the obliged person who has the requested information available, otherwise they shall refuse the request by a decision.
If the obliged person does not comply with the request even in part, they shall issue a written decision within the legally stipulated period.
Against the decision of the obliged person to refuse the requested information, an appeal may be filed within 15 days from the delivery of the decision or the vain expiration of the period for the decision on the request. The appeal is submitted to the obliged person who issued or was supposed to issue the decision.
The appellate body shall decide on the appeal within 15 days from the delivery of the appeal by the obliged person. If the appellate body does not decide within this period, it is assumed that it issued a decision by which it rejected the appeal and confirmed the contested decision; the second day after the expiration of the period for issuing the decision is considered the day of delivery of this decision.
The obliged person shall not issue a decision in the case that the request was set aside. Setting aside the request is not delivered to the applicant; it is only marked in the request file. There is no appeal against setting aside a request.
In the case of a decision to discontinue the proceedings due to the withdrawal of the request by the applicant, no decision is issued because the discontinuation of the proceedings is preceded by the applicant's submission of a withdrawal of the request. The discontinuation of the proceedings for this reason is not delivered to the applicant; the obliged person shall draw up a record of the discontinuation of the proceedings and mark this fact in the request file. There is no appeal against the discontinuation of the proceedings due to the withdrawal of the request.
Information for which the amount of material costs associated with making copies and sending the information (hereinafter referred to as "costs") does not exceed 5.62 EUR is provided free of charge. Information provided to the applicant orally, by fax, by e-mail or by any other technically feasible means is also provided free of charge.
Costs exceeding 5.62 EUR can be paid by

b) cashless transfer to an account in the State Treasury,

The amount of costs associated with the provision of information, with the exception of the amount of costs associated with sending information by post, is determined according to the schedule regulating the reimbursement of costs for the provision of information.
