Natural and legal persons (except for remand prisoners and sentenced prisoners), who seek protection of their rights or legally protected interests, which they believe were violated by the activity or inactivity of a remand prison, a prison, or the Directorate General of the Corps of Prison and Court Guard (hereinafter referred to as "public administration body"), point out specific shortcomings, especially the violation of legal regulations, the removal of which is within the competence of these public administration bodies, for the purpose of protecting their rights may file complaints
pursuant to Act No. 9/2010 Coll. on complaints as amended.
A complaint pursuant to this Act is not a submission which:
a) has the character of an inquiry, expression, opinion, request, suggestion, or proposal,
b) points out specific shortcomings in the activity of a public administration body, the removal or handling of which is governed by a special regulation,
c) is a complaint according to a special regulation,
d) is directed against a decision of a public administration body issued in proceedings according to a special regulation,
e) is directed against the conclusions of a control, audit, supervision, oversight, or inspection according to a special regulation, or
f) contains classified information or from the content of which it is evident that handling it as a complaint according to this Act would lead to a threat to classified information according to a special regulation.
Filing a complaint
The complaint must be in writing and can be submitted in paper form or in electronic form. The complaint must contain the name, surname, and residence address of the complainant. If the complaint is filed by a legal entity, it must contain its name and seat, and the name and surname of the person authorized to act on its behalf.
A complaint in paper form must contain the handwritten signature of the complainant. If it is possible to deliver documents to the complainant in electronic form, it may also contain the complainant's address for such delivery. The complaint must be legible and understandable. It must be clear from it against whom it is directed, what shortcomings it points out, and what the complainant is seeking. If the complaint does not contain the required details, the public administration body shall set it aside.
A complaint submitted in electronic form must be authorized by the complainant according to a special regulation (§ 23 par. 1 of Act No. 305/2013 Coll. on electronic form of exercising the powers of public authorities and on the amendment and supplementation of certain acts (e-Government Act) as amended); this does not apply if the complaint was sent through an access point that requires successful authentication of the complainant (§ 19 of the e-Government Act).
If a complaint submitted in electronic form is neither authorized nor sent through an access point that requires successful authentication of the complainant, the complainant must confirm it within five working days of its submission, namely by a handwritten signature, its authorization, or its submission through an access point according to the e-Government Act that requires successful authentication of the complainant, otherwise the complaint shall be set aside. If the confirmation of the complaint contains different data than the complaint submitted in electronic form, the public administration body shall set aside the complaint submitted in electronic form.
